Important information about Netwealth's Innovation Toolkit competition.

By opting to find out more about Netwealth Investments Limited's Innovation Toolkit and entering the competition to win a full-day Netwealth-facilitated workshop (the Competition), you are agreeing to the following terms and conditions (Terms): 

1. Competition Promoter:

a. Netwealth Investments Limited (ABN 85 090 569 109 AFSL 230975) (Netwealth), Level 8, 52 Collins Street, Melbourne, VIC 3000, Telephone 1800 888 223.
b. Competition authorised under NSW permit number: LTPS/18/25143

 2. Time frame

a. The Competition entry period commences on 29/05/2018 at 00:05am AEST and concludes on 01/07/2018 at 05:00pm AEST unless before that time Netwealth in its discretion specifies a later conclusion time by publication on its website (www.netwealth.com.au) in which case that later conclusion time will apply. Competition has been extended to 1/9/2018. Entries must be received by Netwealth prior to the Competition close time in order to be valid.

3. Entrants and entries

a. Competition entry is open to all residents of Australia aged 18 years or over who attend or are represented at the 2018 Adviser Innovation Summit, work in a financial advice practice or similar as at the Competition prize draw date, and are not officers or employees of Netwealth or its associate, nor an immediate family member of any such officer or employee.
b. To enter the Competition, an eligible entrant must complete the physical or online Competition entry form and submit it within the Competition period with all required details completed (“Qualifying Entry”).
c. Each eligible entrant may submit one entry only.
d. Once submitted, all entries become the property of Netwealth.
e. Netwealth has the right to disqualify any entrants or entries where Netwealth reasonably suspects any unlawful or improper conduct or breach of these Terms.
f. Netwealth will not be responsible for any late or failed entry due to error, omission, interruption, deletion, defect, delay in operation or transmission.
g. To the extent permitted by applicable law (including those regulating trade promotion lotteries) Netwealth reserves the right to withdraw, vary or postpone the Competition or any aspect of it, to the extent reasonably required to take account of any circumstances outside Netwealth’s reasonable control that prevent or substantially hinder Netwealth from conducting the Competition in accordance with these Terms. Each Qualifying Entry will be deemed a Qualifying Entry into any postponed or varied Competition.

4. Privacy & permitted uses of entrants’ information

a. By entering the Competition, you are agreeing to provide your contact details (full name, email, mobile or landline phone number, company and State) to Netwealth for use in accordance with Netwealth’s Privacy Policy, which include permissions for Netwealth to send you marketing and promotional communications. We respect your right to Privacy and you can subsequently opt out of these communications at any time.  Please visit our website www.netwealth.com.au to read our Privacy Policy.
b. By entering the Competition, you are also agreeing to Netwealth publishing your name and employer details together with prize details on Netwealth’s website (www.netwealth.com.au) and, if Netwealth so chooses, via social media, in an announcement of the Competition winner.

5. Prize

a.The prize comprises Netwealth human resources and hard and soft copy resources relating to advice practice innovation, to be delivered via an ‘innovation workshop’ (the Workshop) facilitated by Netwealth using Netwealth’s own innovation toolkit. Workshop details will be as follows unless Netwealth agrees otherwise:

i. Where: The Workshop will be conducted over one business day during business hours at the Winner’s business premises (conditional on Winner arranging a suitable space).
ii. Who: Workshop will be delivered by at least one (1) Netwealth staff member (staff numbers and identities to be determined by Netwealth in its discretion).  Attendees at the Workshop, which may but need not include the Winner, must be officers or employees of the employer organisation or advice licensee represented by the Winner.  Up to 20 eligible persons may attend the Workshop.
iii. When: The Workshop will be held on a mutually convenient date which is to be agreed within 28 days of the Winner claiming their prize. The Workshop itself must be conducted within 6 (six) months of the
competition entry close date.
iv. Prize value: Approximately $2,500 based on one Netwealth staff facilitator at the Workshop.
v. Competition prizes are not transferable, exchangeable or refundable except as permitted by these Terms.

b. Netwealth is and will remain at all times the sole owner of the copyright and intellectual property rights comprised in the Netwealth innovation toolkit and the Workshop and in all materials and information made available to Workshop attendees or otherwise in connection with this Competition. However, Netwealth will not own copyright in or other rights to any works or intellectual property created by Workshop attendees and derived from the Netwealth innovation toolkit.
c. Netwealth may, in its complete discretion, agree with the Winner to instead deliver a substitute prize of equal or greater value instead of the Workshop.
d. Netwealth may offer a substitute prize of equal or greater value without the Winner’s agreement if delivery of the Workshop becomes impossible due to reasons outside Netwealth’s reasonable control and reasonable attempts to reach agreement with the Winner regarding the Prize are unsuccessful.

6. Prize draw and Winner

a. The Prize drawn will be conducted at 1:00pm at Netwealth’s offices on 02/07/2018 unless before that time Netwealth in its discretion specifies a later draw time by publication on its website (www.netwealth.com.au) in which case that later draw time will apply. Draw date has been extended to 1/9/2018.
b. One (1) entry will be drawn at random from the total pool of eligible entries received. Should Netwealth reasonably determine that the entry drawn is not a Qualifying Entry, that entry will be disqualified and another entry will be drawn until a Qualifying Entry is drawn. The proposed prizewinner is the person whose details are given on the first Qualifying Entry to be drawn (the Winner). 

7. Announcement and notification of the Winner

a.The Winner will be notified in writing by letter or email and, if Netwealth so elects, via Netwealth’s social media channels, within three (3) business days of the Competition draw, and will also announced on Netwealth’s external website for a minimum of 28 days.
b. If, despite Netwealth making every reasonable effort to use the contact information given on the Qualifying Entry, the Winner does not claim the prize by phone or in writing (which may include email) within 3 (three) months, then the Winner is deemed to have forfeited their entitlement to a prize, and Netwealth will conduct a supplementary draw as soon as reasonably practicable. The prize will instead be awarded to the first Qualifying Entry drawn in the supplementary draw, and that entrant will be permitted 10 business days to claim the prize.  Further supplementary draws will be conducted to the extent required until a supplementary Winner claims the prize within 10 business days of their Qualifying Entry being drawn.
c. Any decision of Netwealth as Competition Promoter regarding the interpretation or application of these Terms is final and the Promoter will not enter into correspondence regarding any result or decision.

8. Prize acceptance

If the Winner does not agree a date for holding the Workshop within 28 days of claiming the prize, or is unable to receive the prize within 6 months of claiming it, then unless Netwealth agrees otherwise in its discretion, the Workshop will be deemed forfeited by the Winner, no cash or substitute prize will be offered or awarded in lieu of the Workshop, no alternative winner will be determined, no prize will be awarded for this Competition, and Netwealth will have no liability or obligation to the Winner or any other person in connection with the Competition.

9. Liability

Netwealth will not be liable for any misadventure, accident, injury, loss, liability, damage or claim suffered or allegedly suffered directly or indirectly by any person in connection with the conduct of this Competition or the delivery of the Workshop (or any substitute prize).  Without limiting the foregoing, Netwealth will have no responsibility for any loss or harm directly or indirectly resulting from:

a. any person’s authorised or unauthorised use, misuse or distribution of the Netwealth innovation toolkit or any resource, training, education or information provided by Netwealth or its representative at or in connection with the Workshop;
b. any person’s infringement of intellectual property or other rights relating to the Netwealth innovation toolkit or any other aspect of the Workshop, in each case whether those rights are held by Netwealth or any other person; or
c. any accident or injury incurred by any person at the Winner’s premises in connection with Netwealth delivering or facilitating, or a person participating in, the Workshop.
